Welcome and acceptance
By using eid.masgarti.com and the related EiD mobile applications (together, the "Service"), you agree unconditionally to accept and comply with these terms and conditions (the "Terms") and may not modify them.
The Service is operated by Electronic Identity Display Limited ("EID", "we", or "us").
EiD is a digital identity and social networking platform. It allows you to create and make public user profiles, and profiles may be searched by name where that feature is enabled.
Terms of Use (EULA) for the iOS app
If you download or use the EiD app from the Apple App Store, Apple's Licensed Application End User License Agreement (standard EULA) also applies to that Licensed Application. These Terms cover your use of the EiD Service (website and account features). Where both apply, the Apple standard EULA governs the Licensed Application license, and these Terms govern use of the Service. Paid subscriptions purchased through the App Store are billed by Apple. Manage or cancel those subscriptions in your Apple ID subscription settings. Refund requests for App Store purchases are handled by Apple under Apple's applicable policies.
Privacy
Your use of the Service is subject to EID's Privacy Policy. The Privacy Policy also describes the company's data collection practices.
Electronic communications
Visiting the Service or sending emails to EID constitutes electronic communications. You consent to receive all agreements, notices, and disclosures electronically, and you agree that electronic communications satisfy any legal requirement that such communications be in writing.
Your account
You must maintain the confidentiality of your account and password, and restrict access to your account. You are responsible for all activities that occur under your account or password. You may not transfer or assign your account to others or to any other entity. EID is not responsible for third-party access to your account resulting from theft or misappropriation. EID may, at its sole discretion, refuse service, cancel service, terminate accounts, or remove or edit content.
You may request account deletion in the EiD mobile app (Settings → Delete Account). Deletion deactivates your account so you can no longer sign in. Restoration, if available, requires contacting support.
Children under thirteen / under eighteen
Under 13: EID does not knowingly collect personal information from persons under the age of thirteen, either online or offline.
Under 18: You may use the Service only with permission from a parent or legal guardian.
Links to third-party sites / third-party services
The Service may contain links to other sites ("Linked Sites"). Linked Sites are not controlled by EID, and EID is not responsible for their content or updates. EID provides these links for convenience only and does not imply endorsement.
Some features or services are provided by third parties. By using them, you agree that EID may share necessary information or data with relevant third parties to provide the requested product, service, or functionality.
No unlawful or prohibited use / intellectual property
You are granted a non-exclusive, non-transferable, revocable license to access and use the Service only in accordance with these Terms. You warrant that you will not use the Service for any unlawful or prohibited purpose. You may not damage, disable, overload, or impair the Service, or interfere with other users' experience. You must not obtain materials or information other than those intentionally made available through the Service.
Content on the Service (text, graphics, logos, images, software, and compilations) is the property of EID or its suppliers and is protected by copyright and other intellectual property laws. You may not remove or alter copyright, proprietary rights, attribution notices, or restrictions. You may not modify, publish, transmit, reverse engineer, participate in transfer or sale, create derivative works, or exploit any Service content in any other way. The content is not for resale. Unless EID and the copyright owner provide express written permission, you may not use the content for any purpose other than personal use. You do not acquire any ownership rights in any protected content. Except as expressly authorized in these Terms, EID provides no express or implied licenses to any intellectual property.
Third-party accounts
You may connect your EID account to third-party accounts. By connecting, you consent to continuous disclosure of information about you to others in accordance with the third-party platforms' privacy settings. If you do not want your information to be shared, do not use this feature.
International users
The Service is operated and administered by EID within Hong Kong. If you access the Service from outside Hong Kong, you must comply with local laws. You agree not to use Service content in any country or manner that violates applicable laws or restrictions.
Indemnification
You agree to indemnify, defend, and hold EID harmless from losses, costs, liabilities, and expenses arising from or related to your use or inability to use the Service, any content you post, your violation of these Terms, your infringement of third-party rights, or your violation of applicable laws. EID may, at its own cost, assume exclusive defense and control of any matter subject to your indemnification, and you must fully cooperate.
Arbitration
If the parties cannot resolve any dispute through negotiation, the dispute will be resolved exclusively through final and binding arbitration. Arbitration will be conducted under the Hong Kong Arbitration Ordinance, by a single neutral arbitrator. It will be administered by a Hong Kong arbitration body (or a similar arbitration service selected by the parties). The arbitration location will be mutually agreed upon by the parties. The arbitration award is final and may be entered in any court having jurisdiction. The prevailing party is entitled to recover its costs and reasonable attorneys' fees.
Class action waiver
Any arbitration under these Terms will take place individually. Class arbitration or class or representative actions are not permitted. You may bring claims only in your own individual capacity and not as a plaintiff or class member (including in the form of a private attorney general action). Unless both you and EID agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Liability disclaimer
There may be inaccuracies or typographical errors. Content or services may be changed periodically. EID does not guarantee that information, software, services, or related graphics are suitable, reliable, available, timely, accurate, or appropriate for any purpose.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYTHING IS PROVIDED "AS IS" AND EID DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT). TO THE MAXIMUM EXTENT PERMITTED BY LAW, EID IS NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, OR PROFITS), EVEN IF EID HAS BEEN ADVISED THAT SUCH DAMAGES MAY OCCUR. If some states or jurisdictions do not allow the exclusion or limitation of consequential or incidental damages, the limitations may not apply to you. If you are dissatisfied with any portion of the Service or these Terms, your sole and exclusive remedy is to stop using the Service.
Termination / access restriction
EID may terminate or restrict your access to the Service and related services at any time, at its sole discretion, without notice. These Terms are governed by the laws of the HKSAR. All disputes agree to exclusive jurisdiction and venue in the courts of Hong Kong. Using the Service in any jurisdiction that does not give effect to all provisions of these Terms (including this section) is unauthorized.
This agreement does not create any joint venture, partnership, employment, or agency relationship between you and EID. EID's performance is subject to existing laws and legal process, and nothing in the agreement prevents EID from complying with government, court, or law-enforcement requests related to your use or information collected. If any part of the agreement is invalid or unenforceable, it will be replaced with a valid, enforceable provision closest to the original intent; the rest remains in effect. This agreement is the entire agreement between you and EID and supersedes all prior communications or proposals. The agreement in English and electronic notices can be used as evidence in judicial or administrative proceedings. It is the express wish of the parties that this agreement and related documents be written in English.
Changes to Terms
EID reserves the right to change these Terms at its sole discretion. The latest version of the Terms will supersede prior versions. EID encourages you to review the Terms periodically to stay informed of updates.
